2. The service

Song4 lets you create personalized songs generated with automated music-composition technology from the information you provide (dedication, names, story, style). The service works with tokens ("credits"): you buy a token package and use them to generate songs and activate add-ons (second version, instrumental, alternative voice, dedication page, publishing to Spotify).

As the output is generated automatically, the result is unique but not guaranteed: we do not warrant that it will exactly match your subjective expectations or be identical to a previous request.

3. Account, registration and checkout

An account is required to use the service. You can sign up with email/password, with a social provider (Google, Apple) or via express checkout, where the account is created with your email only and the password is set later.

You are responsible for the accuracy of the data provided, for safeguarding your credentials and for the activity carried out through your account. The service is reserved for people aged 18 or over (or 16 with the consent of a parent/guardian).

4. Prices, payments and tokens

• Package prices are shown on the Site, inclusive of applicable taxes, in your region's currency (EUR, USD, RON, PLN).
• Payments are handled by Stripe and PayPal. Song4 does not store full card data.
• Tokens are credited after payment confirmation and do not expire. A token used to start a generation is considered consumed even if the result does not satisfy you.
• Discount codes are subject to the conditions stated at the time of issue.

5. Immediate performance and digital content

Songs and digital content are supplied immediately once generation starts.

By starting the creation, you expressly request that performance of the service begin immediately and acknowledge that, as this is the supply of digital content not on a tangible medium, you lose the right of withdrawal once performance has begun, pursuant to art. 59(o) of the Italian Consumer Code (Legislative Decree 206/2005) and Directive 2011/83/EU.

6. User content and responsibility

You provide information and materials (names, dedications, stories, any images). You represent and warrant that you hold all necessary rights to such content and that its use does not infringe third-party rights or any law. You grant Song4 a limited license to process it solely to provide the service.

It is prohibited to request or upload content that, by way of example:

• imitates the voice, vocal style or identity of real artists or well-known figures without the right to do so;
• uses names, images or voices of real people without their consent;
• is unlawful, defamatory, obscene, discriminatory or incites hatred or violence;
• infringes trademarks, copyright or other third-party rights.

You indemnify Song4 against any third-party claim arising from breach of these warranties.

7. Intellectual property and license of use

Unless otherwise agreed, you receive solely a personal, non-commercial license of use, perpetual and worldwide, over the generated song (listening, private sharing, use as a gift). You do not acquire ownership of the track or any right of economic exploitation; any commercial use requires a separate agreement.

Copyright protection for automatically generated content may vary depending on the jurisdiction and the technology provider's terms: Song4 does not guarantee that the output is protectable as an intellectual work nor its absolute exclusivity. The Site's trademarks, logos, software and graphics remain the property of Song4 or their respective owners.

8. Publishing to Spotify and other platforms

If you activate the option, Song4 handles distribution of the song to streaming platforms. Tracks are published under the umbrella artist «Song4», through third-party providers. For tracks created in Lyrics Mode (lyrics written by you), you are credited on the platforms as Lyrics Author / Lyricist; in other cases no personal credit is provided. Timing depends on the platforms and is not guaranteed; final acceptance of the track is subject to platform policies. No distribution of royalties, proceeds or compensation deriving from streams or sales of the published tracks is provided: the service is for publication and visibility, not for economic exploitation in your favor. By activating the option, you authorize distribution and declare you hold the rights to the content used. Song4 may remove a track in case of reports or violations.

9. Acceptable use

You undertake not to: (a) circumvent the Site's security or access limits; (b) use unauthorized bots or automated tools; (c) resell the service or the tokens; (d) use the service for unlawful purposes. Song4 may suspend or close accounts in case of violation.

10. Availability and warranties

We strive to keep the service running but do not guarantee uninterrupted or error-free operation. The service is provided "as is", within the limits permitted by law and without prejudice to consumers' mandatory rights.

11. Limitation of liability

To the maximum extent permitted by law and without prejudice to non-excludable liability towards consumers, Song4's total liability is limited to the amount paid by the user in the 12 months preceding the event. Song4 is not liable for indirect damages, loss of data or profits.

12. Changes to the Terms

We may update these Terms. Material changes will be communicated via the Site or by email. Each version is identified by number and date; new transactions are governed by the version in force at the time of purchase, recorded with the order.

13. Governing law and jurisdiction

These Terms are governed by Italian law. For consumers, the court of the place of residence or domicile applies where mandatory. EU users have access to the European Commission's ODR platform: ec.europa.eu/consumers/odr.
